BYELAWS RENDERING NECESSARY LICENSES FOR THE USE OF PREMISES WITHIN CANTONMENT AS STABLES OR COW OR CATTLE OR AS ACCOMODATION FOR SHEEP, GOATS OR FOWLS FOR PROFIT UNDER SECTION 210, 282(16) , 282(39) AND 283 OF THE CANTONMENTS ACT, 1924.

 
     
 
1.
No person shall keep for profit six or more goats within the Cantonment limits without first obtaining a license from the Cantonment Board
 
2.

Within such limits as the Cantonment authority may determine no milkman, cart man or keepers of hackney carriages or other person shall stable, horses, ponies or cattle for the purpose of trade or business, except under a license obtained by such person from the Cantonment authority and renewable annually.

 
3.

The Cantonment authority may charge a fee of not exceeding Re.1/- for the issued or renewal of any such license and may impose such condition in respect thereof as it thinks fit.

 
4.

A breach of the byelaws Nos. 1 and 2 above shall be punishable with a fine, which may extend to Rs.20/- (twenty).

 

The following conditions have been imposed by the Cantonment Board Dehradun as required by rule 3 of the byelaws rendering necessary licenses for the use of premises within Cantonment as stables or cow or cattle sheds or as accommodation for sheep goats or fowls for profit under section 210, 282(16), 282 (39) and 283 of the Cantonments Act, 1924.

 
(i)

Only such premises as conform to the following conditions shall be licensed, namely:-

 
(a)

that the premises or part of premises are not less than 10 feet in height measured from the floor to the eaves of the roof, provided that the existing stables may be allowed to be used if they are adequately ventilated and have satisfactory arrangements for drainage;

 
(b)

that the floor of the premises is at least six inches above the level of the open space, or the street on to which they open, is paved with some impervious materials and is sloped away towards the drain;

 
(c)

that the premises are so situated as to admit of their being properly drained directly into a drain or cesspool set part for the purpose, and constructed of some impervious material and in such a way that the contents are easily removable;

 
(d)
That the premises are provided with adequate ventilation
 
(e)

that there is no opening from the premises likely to permit direct ventilation there from into any cooking place or any place used for human habitation;

 
(f)

In the case of premises to be used for milch-cattle;

 
1.

that the premises are surrounded by an open space not less than 15 feet wide, and that they are open to such a space on at least two sides, and

 
2.
that there is provided in the open space, surrounding the premises a paved space of an area equal to not less than one-seventh of the floor area of the premises, on which the cattle may be washed down
 
(g)

that each cow or pony has been provided with a clear space of 8'x4', each mule or buffalo 8'x5', each horse 5'x9', and each sheep or goat 4'x3'.

 
(h)
that the premises are fenced with a proper hedge or barbed wire fence all around and are provided with only one or two gates.
 
(ii)

A license for the use of any place or premises as a stable shall be issued to the owner or occupier of such place or premises by the Executive Officer, in accordance with the directions, which may, from time to time, be issued by the Cantonment Board. The license shall prescribe the number and description of animals to be kept on the licensed premises.

 
(iii)

Every such license shall be granted subject to the following conditions, namely:-

 
(a)

that the licensee shall not at any time keep, or permit to be kept, in the licensed premises, any animals in excess of the number prescribed in his license, or of a description other than specified therein;

 
(b)

that the licensee shall not permit any syce, or any other person, to cook food in the licensed premises or to use them for human habitation, provided that one or more attendants to be specified in the license may be permitted to sleep on the licensed premises to prevent accident among the animals;

 
(c)

that the licensee shall provide in some convenient place a receptacle or receptacles for dung litter, etc.. Such receptacles shall be of such form and of such material, as the Executive Officer may direct and shall be of a capacity of not less than 1 & 1/2 cubic foot for each animal kept on the premises;

 
(d)

that the licensee shall not keep on the licensed premises any litter or dung in such a situation or manner as to pollute, or likely to pollute, any drinking water;

 
(e)

that the licensee shall cause the licensed premises to be properly cleaned twice daily, once in the morning and once again in the evening, and to be washed down once every week.

 
(f)

that the licensee shall make suitable arrangements to the satisfaction of the Executive Officer, for the daily removal and disposal of litter, dung, rubbish etc. by incineration of otherwise;

 
(g)

that the licensee shall give every facility to the Executive Officer, or any other officer or servant appointed by the Cantonment Board in this behalf, to inspect the licensed premises, and the animals kept thereon, at any reasonable time;

 
(h)

that on the occurrence of the out break of any infectious disease among the cattle kept on the licensed premises the licensee shall immediately inform the Executive Officer of the fact, and shall segregate the animals affected pending his order, and

 
(i)

that the licensee shall cause all milch cattle to be properly washed down at least once a week.

 
 
 
 
A license granted under byelaws 2 shall remain in force up to 31st March following date of issue, unless cancelled or suspended earlier for a breach of any of the condition thereof.
